Terms of service

These terms govern your use of bgbust.com (the "Service"). By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service. "We", "us", "BGbust" refers to the operator of bgbust.com. "You" is the natural person or legal entity using the Service.

The Service

BGbust is a web application that removes backgrounds from images. The Free tier processes images locally in your browser. Paid tiers (Starter, Pro, Business) route images through our cloud processing partner for higher-quality output. We may add, remove, or modify features at any time. Material changes will be announced in advance.

Your account

You must provide a valid email and choose a password of at least 8 characters. You are responsible for keeping your credentials confidential. You must be 16 or older to create an account. One account per natural person — multi-accounting to circumvent free-tier limits is prohibited and may result in termination without refund.

Acceptable use

You may not: process images you do not own or have legal right to use; process images depicting CSAM, illegal content, or non-consensual intimate imagery; resell, sublicense, or rebrand the Service; scrape, mirror, or systematically access the Service via automated means outside of our API (when offered); attempt to circumvent rate limits, quotas, or security controls; reverse-engineer the Service.

Plans, billing & subscriptions

Free tier: 4 lifetime background removals per account, on-device processing. Paid plans: Starter $4.99/mo (75 cutouts), Pro $12/mo (300 cutouts), Business $49/mo (1,500 cutouts). Annual plans available at ~17% discount. Subscriptions auto-renew at the end of each billing period. You may cancel at any time from your account page or Stripe portal — cancellation takes effect at the end of the current paid period, with no further charges.

Refunds

Monthly plans: no refunds for partial periods, but you keep access until the period ends. Annual plans: pro-rata refund of unused time if you cancel within 30 days of purchase. Erroneous charges (duplicate billing, wrong plan): full refund within 14 days, email billing@bgbust.com. We reserve the right to refuse refunds for accounts violating these Terms.

Fair use & soft caps

Each paid tier has a monthly soft cap (Starter 75, Pro 300, Business 1,500). Sustained use beyond your cap may result in: an email asking you to upgrade, throttling of new requests, or — in cases of abuse or commercial reselling — account suspension. We will email you before any action that affects service availability.

Ownership of content

You retain all rights to the images you upload. We claim no ownership of inputs or outputs. We do not use your images to train models. By using the Service, you grant us a limited, non-exclusive license to process the image solely to deliver the requested cutout — that license terminates the moment processing completes.

Service availability

We aim for 99.5% monthly uptime but make no guarantee on Free, Starter, or Pro tiers. Business customers may negotiate a written SLA. We are not liable for outages caused by upstream providers (Photoroom, Stripe, Cloudflare, Hetzner). We will not be liable for losses arising from temporary unavailability.

Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or business interruption. Some jurisdictions do not allow such limitations — in those jurisdictions our liability is limited to the maximum extent permitted by law.

Termination

You may close your account at any time from /account. We may suspend or terminate your account if you breach these Terms, with notice where reasonable. Upon termination: paid plans are not refunded for partial periods (except per the Refunds section), and your data is deleted within 30 days unless legal retention obligations apply.

Governing law & disputes

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Any dispute will be brought before the competent courts of Berlin, Germany — except where consumer-protection laws in your jurisdiction grant you the right to bring claims locally. Nothing in these Terms limits statutory consumer rights.

Changes to terms

We may update these Terms. Material changes will be announced by email at least 30 days in advance and posted at https://bgbust.com/terms. Continued use after a change means you accept the updated Terms.
